Taxes, taxes, and more taxes–why not? Who would have known that the mere mention of “taxes” would set off very confusing thoughts, some of them very negative or just “uninformed” ideas towards taxes, charities, and the church and how it relates to their exemption status and historically, why. Recently I received an email with some very foul language because I took the position of siding with tax exemption status for the church. In researching the tax issue, I decided to substantiate the reason(s) for the exemption; further, I noticed that some very powerful organizations and/or foundations are also tax exempt but little to none public information is being made available that they are tax exempt.

Following is a partial list of non-profit charities, public and private foundations, and churches that IRS allows for tax exemption, under IRS Section 501(c)(3):

  • schools;
  • hospitals;
  • social service agencies;
  • The Red Cross;
  • universities and colleges;
  • scientific organizations;
  • museums;
  • or other charitable organizations, ie: Cornell University, United Way;
  • including but not limited to private foundations, ie: the Bill Gates Foundation; General Electric Foundation, Triad Foundation, Packard Foundation, Hines Endowment ( the Teresa Hines Kerry family), Carnegie and Rockefeller Foundations; and,
  • churches

The Revenue Act of 1862 created the Office of Commissioner of Internal Revenue to help fund the Civil War, now operating currently under the U.S. Treasury Department. Enacted in 1894, the first federal income tax contained an exemption for any corporation or association organized for religious, educational, or charitable purposes. The U.S. Supreme court declared this statute unconstitutional in 1895; however subsequent enactments of the IRS Income Tax Code have all contained exemptions as a result of the wording.

The Corporation Excise Tax of 1909 contained a provision to the effect that the tax did not apply “to any corporation or association organized or operated exclusively for religious, educational, or charitable purposes…” In the Revenue Act of 1913 the federal government exempted the churches and included various other organizations from federal taxation under the modern federal tax code.

To be exempted under IRS Section 501(c)(3), an organization must apply for recognition of exemption by filing a completed Form 1023 and satisfying various requirements before being approved by the IRS. Historically, the establishment of a “church” and exemption from taxes goes even further as shown in the bible (which is recognized as the inspired word of God), excerpted here, in part:

  • In the Book of Chronicles (circa 425 – 400 BC) God is speaking to King David, stating: “Wherever I have moved with all the Israelites, did I ever say to any of their leaders whom I commanded to shepherd my people ‘Why have you not built me a house of cedar?’ (1 Chronicles 17:6);
  • “Then King David said to the whole assembly: “My son, Solomon, the one whom God has chosen, is young and inexperienced. The task is great, because this palatial structure is not for man, but for the LORD, God.” (1 Chronicles 29:1);
  • In the Book of Ezra, King Artazerxes gave to Ezra, the priest, (circa 538-457 BC) reading, in part:
  • “This is a copy of the letter that King Artaxerxes gave Ezra the priest, the scribe, the expert in the words of the commandments of the LORD, and of his statutes of Israel:” (Ezra 7:11);
  • “Whatever is commanded by the God of heaven, let it diligently be done for the house of the God of heaven. For why should there be wrath against the realm of the king and his sons?” (Ezra 7:23);
  • “Also, we inform you that it shall not be lawful to impose tax, tribute, or custom on any of the priests, Levites, singers, gatekeepers, Nethinim, or servants of the House of God.” (Ezra 7:24)

As a firm believer in the word of the Lord, I sincerely state that imposing any type of tax, tribute or custom is highly offensive, since God Almighty is the owner/creator of heaven and earth. Honoring the house of God is paramount, especially, in this day and age. I, also, personally do not have any problems with any public or private organizations applying for and receiving an exemption under current federal guidelines. But I don’t feel it’s ok to subjugate the church to any less of the privilege if people are uninformed about who qualifies for exemptions and why they qualify.

Summarily, the exemption from taxes operates both spiritually and by government as an inherent “right of operation.”
